TERMS AND CONDITIONS

INTRODUCTION AND PURPOSE

Moto.pt is an online platform created and managed by Tender Touch, LDA, with headquarters at Largo Machado de Assis, No. 2, Shop D, 1700-116 Lisbon, registered under NIF 518174034. This platform’s main goal is to facilitate the purchase, sale, and advertising of vehicles, including motorcycles, cars, and commercial vehicles. In addition, it offers a communication interface between users, complemented by an informative blog that provides updates and news on the world of motorcycles and cars, both in Portugal and internationally.

The purpose of Moto.pt is to provide the Portuguese public with a satisfactory and pleasant experience in choosing their preferred means of personal transport, combining useful information with a practical and intuitive platform.

By accessing and using the Moto.pt website, the user declares their full acceptance of these Terms and Conditions. The user also recognises that these terms may be amended at any time, and it is their sole responsibility to periodically check for published updates.

REGISTRATION AND ACCESS LEVELS

Moto.pt offers different levels of access adapted to the needs of its users, divided into two main categories: non-professional users (private individuals) and professional users (dealers, automotive sector companies, and other commercial agents). Each access level provides specific features, aligned with the objectives and interests of each type of user.

1. User Registration

  • 1.1. Registration on the platform is mandatory to access certain features, such as:
    • Posting adverts;
    • Managing active adverts;
    • Direct communication with other users;
    • Participation in blog discussions and events promoted by the Moto.pt community.
  • 1.2. During the registration process, the user must provide complete, true, and up-to-date information, including:
    • Full name or company name (for companies);
    • Valid email address;
    • Valid contact phone number (advertiser’s number);
    • Additional information required for identification or validation of the professional profile, when applicable.
  • 1.3. The user declares they are over 18 years old and guarantees the authenticity of the information provided. The use of false or misleading information may result in the suspension or cancellation of registration, without prejudice to other applicable legal measures.
  • 1.4. Platform visitors who do not register but wish to view vehicle adverts have limited access to functionalities. Without registration, users cannot:
    • Use the price negotiation tools or propose exchanges directly to sellers;
    • Communicate via chat with advertisers;
    • Save vehicles of interest to a favourites list or follow price changes in specific adverts.

Registration is therefore essential to guarantee a complete and personalised experience on the Moto.pt platform.

2. Access Levels

  • 2.1. Non-Professional Users:
    • Intended for private individuals wishing to buy, sell, or consult vehicle adverts.
    • Access includes features such as posting free adverts (limited by category and quantity) and interacting with other users.
  • 2.2. Professional Users:
    • Intended for dealers, automotive sector companies, and other commercial agents.
  • 2.3. Moto.pt reserves the right to request additional documentation to validate professional user status, such as proof of business activity or commercial licences.

NOTE: On Moto.pt, all functionalities related to creating and posting adverts are equally available to both private and professional users, ensuring equal access to the platform’s tools.

3. Platform Rights and Obligations

  • 3.1. Tender Touch, LDA reserves the right to refuse, suspend or cancel the registration of any user who:
    • Provides false, incomplete, or outdated information;
    • Uses the platform for illegal, fraudulent purposes, or in violation of these Terms and Conditions;
    • Engages in behaviours that harm the experience of other users or the reputation of the platform.
  • 3.2. In case of cancellation or suspension of registration, Moto.pt will notify the user, whenever possible, indicating the reasons for the decision.

4. Confidentiality and Security

  • 4.1. Data provided during registration will be processed in accordance with the Moto.pt Privacy Policy, ensuring the protection and confidentiality of personal information.
  • 4.2. The user is responsible for maintaining the security of their access credentials (username and password). Moto.pt is not responsible for unauthorised access arising from negligence in protecting credentials.
  • 4.3. If the user suspects unauthorised access to their account, they should immediately inform Moto.pt, which will take necessary measures to protect the data and restore account security.

USER OBLIGATIONS

The use of the Moto.pt platform requires the user to comply with certain responsibilities, which are essential to guarantee the safety, trust and a good experience for all users. These obligations also aim to prevent misuse of the platform, especially in areas where the user has the freedom to add content, such as adverts, where unwanted, fraudulent, offensive or inappropriate information may be shared. By using Moto.pt, the user undertakes to fully comply with the following obligations:

1. Truthfulness and Updating of Information

  • 1.1. To provide complete, truthful, accurate and up-to-date information during registration and use of the platform, including when publishing adverts. The truthfulness of information is essential so that other users can trust the content presented and to avoid fraud or misunderstandings.
  • 1.2. To promptly update any personal data or information related to adverts whenever necessary, to ensure that they remain accurate and in accordance with the Terms and Conditions.

2. Protection of Personal Data

  • 2.1. To respect the data protection rules in force, including the General Data Protection Regulation (GDPR), thus protecting the privacy of users and third parties.
  • 2.2. To obtain the necessary consents before entering or sharing third party personal data on the platform, assuming full responsibility for any data that is published, such as contacts or sensitive information.
  • 2.3. Not to collect or store personal information of other users without explicit consent, thus protecting the privacy and security of everyone involved.

3. Confidentiality and Security

  • 3.1. To keep the confidentiality of access credentials (username and password), as these are personal and non-transferable. The user is responsible for all activities carried out through their account.
  • 3.2. To adopt adequate measures to protect the account against unauthorised access, such as choosing secure passwords and not sharing them with third parties.
  • 3.3. To immediately notify Tender Touch, LDA in case of suspected security breach, unauthorised access or misuse of the account, allowing measures to be taken to mitigate possible damage.

4. Lawful and Ethical Use of the Platform

  • 4.1. To use the platform exclusively for lawful purposes and in accordance with these Terms and Conditions, refraining from:
    • Publishing fraudulent, misleading, offensive content or adverts, or any that violates applicable law;
    • Entering false, incomplete or outdated information in adverts;
    • Using the platform to promote illegal or fraudulent activities, or those that harm the rights or interests of third parties.

Moto.pt allows the user to enter free-form descriptions in adverts, which may include texts, images or other content. This freedom requires responsibility, since any inappropriate, offensive or fraudulent content may harm third parties, undermine trust in the platform, or even break the law.

  • 4.2. Not to interfere with the normal operation of the platform, including but not limited to:
    • Attempting unauthorised access to Moto.pt systems or data;
    • Introducing viruses, malware or any other malicious code that compromises the security and integrity of the platform.

5. Respect for Intellectual and Industrial Property Rights

  • 5.1. To respect the intellectual and industrial property rights of Tender Touch, LDA and third parties, including:
    • Not to copy, reproduce, modify, distribute or improperly use any content from the platform (texts, images, logos, brands, etc.), except with prior and express authorisation.

This respect is essential to protect the originality of content and to avoid legal disputes.

  • 5.2. Not to use the platform to infringe copyright, trademarks or other intellectual property rights of third parties, ensuring an environment of respect and legal compliance.

6. Responsibility for Published Content

  • 6.1. To ensure that all content published (including texts, images, videos or other materials) is of their own authorship, or that they have the necessary rights and permissions for its publication.
  • 6.2. To take full responsibility for any claims, damages or losses arising from content published on the platform that infringes third party rights or applicable law.

Moto.pt offers users the freedom to describe their adverts and add content in a personalised way. However, it is imperative that this freedom is used responsibly, avoiding the publication of content that may be offensive, misleading, defamatory or illegal.

7. Cooperation with the Platform

  • 7.1. To cooperate with Tender Touch, LDA in any investigations related to the use of the platform, providing the necessary information to clarify situations involving possible breaches of the Terms and Conditions.
  • 7.2. To accept that Tender Touch, LDA may request clarification or additional documents to verify compliance with user obligations, in order to ensure the safety and compliance of the platform.

PROCESSING OF PERSONAL DATA

Moto.pt, a brand managed by Tender Touch, LDA, is committed to protecting the privacy and personal data of its users, in accordance with the General Data Protection Regulation (GDPR) and other applicable legislation. This commitment is reflected in how we collect, use, store, and protect the information provided by users.

1. Controller of Data Processing

The controller of personal data processing is Tender Touch, LDA, a legally registered entity based in Portugal, which ensures that user data is processed lawfully, transparently, and securely.

2. Data Collected

In the context of using the Moto.pt platform, the following personal data may be collected:

  • Registration data: name, email address, phone number, and password;
  • Data related to adverts: information about the vehicles advertised, including images and descriptions;
  • Browsing data: IP address, geographical location, device type, and information about the user’s interaction with the platform;
  • Other data voluntarily provided by the user in communications or interactions with Moto.pt.

3. Purposes of Processing

The personal data collected will be used for the following purposes:

  • User account management: creation, maintenance, and authentication of accounts on the platform;
  • Posting of adverts: provision and management of adverts posted by users;
  • Communications: sending notifications, important information, or updates related to the platform;
  • Improvement of user experience: personalisation of content and features based on user preferences and behaviour;
  • Compliance with legal obligations: processing of data as required by law, including fraud prevention and illicit activities.

4. Legal Basis for Processing

The processing of personal data is based on the following legal grounds:

  • Performance of a contract: necessary for the provision of services made available by Moto.pt;
  • Consent: where applicable, the explicit consent of the user will be requested, as in the use of cookies or the sending of marketing communications;
  • Legitimate interest: to ensure the security of the platform and improve the user experience;
  • Compliance with legal obligations: processing necessary for compliance with applicable legal requirements.

5. Data Security

Moto.pt adopts appropriate technical and organisational measures to protect personal data against unauthorised access, loss, alteration or destruction. The platform is hosted on servers located in the national territory, with high levels of security, in accordance with legal requirements.

The database, all platform content and customer data are hosted on servers located at the Altice Covilhã Data Centre, managed by Altice Portugal, an entity recognised for its high-security and reliable infrastructure.

The Data Centre is located at: Transversal Rua da Grila 4, 6200-507 Covilhã, Portugal.

Altice Portugal ensures strict compliance with the security and data protection standards required by applicable legislation, including the General Data Protection Regulation (GDPR). This hosting location guarantees high levels of protection against unauthorised access, loss, alteration or destruction of data, ensuring the integrity and confidentiality of information processed by Moto.pt.

6. Data Sharing

User personal data will not be shared with third parties except in the following situations:

  • Where necessary for the provision of contracted services, such as sharing data with technical service providers or business partners, always in accordance with legal provisions;
  • For compliance with legal obligations, such as responding to requests from public or judicial authorities;
  • With the explicit consent of the user, where required.

6.1. Data on third parties or advertising sources available

As part of Moto.pt's operation, some user personal data may be shared with third parties or processed by external services to ensure the correct functioning and continuous improvement of our services. These third parties include:

  • Authentication and login services: To facilitate registration and login on the platform, we use third-party services such as:
    • Google Sign-In (provided by Google LLC);
    • Facebook Sign-In (provided by Meta Platforms, Inc.);
    • Apple Sign-In (provided by Apple Inc.).
    These services may collect and process personal information, such as name, email address, and profile photo, as authorised by the user when using these login options.
  • Analytics and statistics: To monitor and analyse platform performance and understand user behaviour, we use tools such as:
    • Google Analytics and
    • Google Tag Manager (provided by Google LLC).
    These tools collect anonymous data, such as IP addresses, approximate geographical location, device type, and browsing patterns.
  • Website protection and cache storage: we use services from:
    • Cloudflare and Netlify CDN, providers specialising in security and Content Delivery Network (CDN) solutions.

    Image storage: we use specialised cloud storage services.

  • Payment processing: we partner with the following payment service providers:
    • EuPago (EuPago - Instituição de Pagamento Lda.), a company registered and based in Portugal;
    • PayPal (PayPal (Europe) S.à.r.l., et Cie, S.C.A.).

The data shared with these third parties is limited to what is strictly necessary for the provision of contracted services and is processed in accordance with applicable legal provisions, including the General Data Protection Regulation (GDPR). Moto.pt ensures that all partners and service providers it works with fully comply with the data protection standards required by law.

7. Data Retention

Personal data will be stored only for the period necessary to fulfil the purposes for which it was collected, unless a longer retention period is required by law. After the end of the retention period, the data will be securely deleted.

8. Users’ Rights

  • Right of access: To request information about the personal data processed by Moto.pt;
  • Right of rectification: To correct any incorrect or outdated personal data;
  • Right to erasure: To request the deletion of personal data, unless processing is necessary for compliance with legal obligations;
  • Right to data portability: To receive personal data in a structured, commonly used format, or to request its transfer to another controller;
  • Right to restriction of processing: To restrict the processing of data in certain circumstances;
  • Right to object: To object to the processing of personal data for specific purposes, such as the sending of marketing communications;
  • Right to lodge a complaint: To lodge a complaint with the competent data protection authority, such as the National Data Protection Commission (CNPD).

10. Updates to the Privacy Policy

Moto.pt reserves the right to update this personal data processing policy whenever necessary, to reflect legislative changes or improvements to the platform. Users will be duly informed of any relevant changes.



CANCELLATION AND DELETION

Moto.pt values the freedom and control of users over their accounts and personal data. Therefore, it provides clear mechanisms so that users can, at any time, request the cancellation of their account and the deletion of their data. However, it is important to understand the implications of this process, as described below.

1. Account Cancellation by the User

  • 1.1. The user may request the cancellation of their Moto.pt account at any time, by sending a formal request through the contact channels provided by the platform (email or contact form).
  • 1.2. By requesting the cancellation of the account, the user agrees that:
    • All personal data associated with the account will be deleted from Moto.pt’s records, in accordance with applicable legislation, including the General Data Protection Regulation (GDPR);
    • All adverts posted by the user, as well as the history of previous adverts, will be permanently deleted;
    • Favourites lists, as well as any other personalised data associated with the account, will also be removed;
    • The balance of adverts purchased but not yet used will be lost without the possibility of refund or recovery.
  • 1.3. After the account is deleted, the user's data cannot be recovered and access to the platform will be permanently terminated.

2. Account Deletion for Violation of Terms and Conditions

  • 2.1. Tender Touch, LDA reserves the right to unilaterally delete, without prior notice, accounts of users who violate the Moto.pt Terms and Conditions or any applicable legal provision.
  • 2.2. The reasons that may lead to the deletion of an account include, but are not limited to:
    • Posting fraudulent, misleading, offensive adverts or those that violate applicable law;
    • Using the platform for illicit purposes or purposes harmful to third parties;
    • Attempts at unauthorised access to Moto.pt systems or data;
    • Posting content that infringes the rights of third parties, such as intellectual or industrial property rights;
    • Any action that compromises the security, integrity, or operation of the platform.
  • 2.3. In cases of account deletion for breach of the Terms and Conditions, the user will not be entitled to any kind of compensation, including the recovery of unused advert balance or other benefits associated with the account.

3. Procedures for Cancellation and Deletion

  • 3.1. To request account cancellation, the user must contact Moto.pt using the following means:The request will be processed within a maximum of 30 business days, as provided for by applicable legislation.
  • 3.2. In case of account deletion by Tender Touch, LDA, the user will be informed, whenever possible, of the reasons for the action and the associated implications.
  • 3.3 Alternatively, users can choose to delete their account directly through the Moto.pt platform. To do this, simply go to Settings in the Personal Area and click on the “Delete Account” button. This procedure guarantees the immediate deletion of the account, in a simple and autonomous manner.

4. Consequences of Cancellation or Deletion

  • 4.1. The cancellation or deletion of an account implies the permanent removal of all data and content associated with it, including:
    • User's personal data;
    • Adverts posted and respective history;
    • Favourites lists and other personalised data;
    • Balance of adverts purchased but not yet used, which will be lost without the possibility of recovery.
  • 4.2. Moto.pt cannot be held responsible for any losses resulting from the cancellation or deletion of the account, whether by the user's decision or for violation of the Terms and Conditions.

5. Right to Data Retention in Specific Situations

  • 5.1. In compliance with applicable law, Moto.pt may retain certain personal data for an additional period, even after account cancellation or deletion, when necessary for:
    • Compliance with legal or regulatory obligations;
    • Protection of legitimate interests, such as fraud prevention or dispute resolution.

RESPONSIBILITIES

Moto.pt, managed by Tender Touch, LDA, acts as an intermediary platform that allows users to publish and consult adverts related to vehicles. Despite efforts to ensure a safe and functional environment, Tender Touch, LDA cannot be held responsible for certain situations that are beyond its direct control. Thus, by using the platform, the user acknowledges and accepts the following limitations of liability:

1. Content Published by Users

  • 1.1. Tender Touch, LDA is not responsible for the quality, truthfulness, accuracy, legality, or appropriateness of the adverts published on the platform. Responsibility for the content of adverts lies solely with the users who publish them.
  • 1.2. It is up to users to verify the authenticity of the information presented in adverts before making any transaction or decision based on them.
  • 1.3. Moto.pt reserves the right to remove or suspend adverts that violate the Terms and Conditions but does not guarantee the continuous monitoring of all content published.

2. Improper Use of the Platform

  • 2.1. Tender Touch, LDA is not responsible for damages, losses or harm resulting from the improper use of the Moto.pt platform by users, including:
    • Publication of fraudulent, offensive, or illegal content;
    • Use of the platform for unauthorised purposes, such as spam or actions that violate applicable law;
    • Unauthorised access to user accounts by third parties due to negligence in the protection of access credentials.
  • 2.2. Moto.pt provides guidance and security measures to minimise risks, but the responsibility for proper use of the platform lies with each user.

3. Links to External Sites

3.1. Moto.pt may contain links to external sites provided by third parties to complement the user experience. However, Tender Touch, LDA:

  • Does not control, approve or endorse the content, products, or services made available on these sites;
  • Is not responsible for any damages or losses arising from access, browsing, or use of external sites.

4. Interactions and Transactions

  • 4.1. The platform only serves as a means for negotiations between users;
  • 4.2. It is not responsible for disputes, fraud, or contractual breaches between users.

5. Guarantee of Operation

  • 5.1. Tender Touch, LDA will make efforts to keep the service operational, but does not guarantee continuous availability;
  • 5.2. It is not liable for damages arising from interruptions, technical failures, or cyber attacks.

6. Limitation of Responsibility

  • 6.1. Under no circumstances shall Tender Touch, LDA be liable for indirect, consequential, loss of profits, or any other type of damages resulting from the use or inability to use the Moto.pt platform.
  • 6.2. The responsibility of Tender Touch, LDA is limited to compliance with its legal and contractual obligations as described in the Terms and Conditions.


DISPUTE RESOLUTION, APPLICABLE LAW AND JURISDICTION

Moto.pt, managed by Tender Touch, LDA, undertakes to handle with seriousness and transparency any complaints or disputes that may arise from the use of the platform. Various mechanisms are made available so that users may exercise their rights and resolve any disputes, as described below.

1. Right to Complaint

  • 1.1. The user has the right to submit complaints related to the services provided by Moto.pt or any other matter associated with their use of the platform.
  • 1.2. To facilitate this process, Tender Touch, LDA provides:
    • The Electronic Complaints Book, accessible through the official website: www.livroreclamacoes.pt;
    • Registration with alternative dispute resolution platforms, such as:
      • CIAB – Centre for Information, Mediation and Arbitration of Consumer Disputes (www.ciab.pt);
      • CNIACC – National Centre for Information and Arbitration of Consumer Disputes (www.cniacc.pt).
    • The contact form directly on the Moto.pt platform, available in the Support or Contact Us section;
    • The following direct communication channels:

2. Minimum Requirements for Submission of a Complaint

  • 2.1. For a complaint to be considered valid, the user must include at least the following information:
    • User identification (full name and contact);
    • Clear and detailed description of the reason for the complaint;
    • Date and circumstances related to the problem or incident;
    • Relevant documents or evidence, if applicable (e.g. screenshots, proof of payment, etc.).
  • 2.2. Complaints that do not contain these minimum requirements may be deemed incomplete and not accepted for analysis.

3. Receipt, Registration and Handling of Complaints

  • 3.1. Upon receipt of a complaint, Tender Touch, LDA undertakes to:
    • Register the complaint in the internal complaints management system, assigning a reference number for tracking;
    • Analyse the content of the complaint and verify its admissibility, based on the Terms and Conditions and applicable legislation;
    • Respond to the user within a maximum period of 15 business days, informing them of the status of the complaint and next steps.
  • 3.2. Tender Touch, LDA reserves the right to request additional information from the user, if necessary, for a more complete analysis of the situation.

4. Response Channels and Filing

  • 4.1. Responses to complaints will be sent via the channel indicated by the user at the time of submission, which may be:
    • By E-mail.
    • By registered letter, in specific cases, to the address provided by the user.
  • 4.2. All complaints and respective responses will be filed by Tender Touch, LDA for a minimum period of [insert period, e.g. 3 years], as required by applicable law.

5. Non-Admissibility of Complaints

  • 5.1. Tender Touch, LDA reserves the right not to admit complaints that:
    • Do not meet the minimum requirements described in point 2;
    • Are manifestly unfounded, abusive or repetitive;
    • Are outside the scope of competence of Moto.pt or are unrelated to the services provided by the platform.
  • 5.2. If a complaint is not accepted, the user will be informed of the reasons and, whenever possible, advised of the steps they can take to rectify the situation.

6. Alternative Dispute Resolution

  • 6.1. In situations where it is not possible to reach a direct agreement between the user and Tender Touch, LDA, the user may turn to the alternative dispute resolution entities mentioned in point 1.2.
  • 6.2. These mechanisms are intended to provide a fair, speedy, and cost-effective solution for both parties, avoiding recourse to the courts.

7. Applicable Law and Competent Jurisdiction

  • 7.1. All disputes related to the use of the Moto.pt platform shall be governed by Portuguese law.
  • 7.2. In the absence of amicable or alternative resolution, the competent court shall be the court of the district corresponding to the registered office of Tender Touch, LDA, unless otherwise required by law.

Moto.pt, managed by Tender Touch, LDA, is committed to protecting the privacy and personal data of its users. This document describes how we collect, use, share, and protect users’ personal data, in accordance with the General Data Protection Regulation (GDPR) and other applicable legislation.

  • 1.1. This Privacy Policy applies to all users of the Moto.pt platform, including visitors, advertisers, and buyers.
  • 1.2. Moto.pt undertakes to ensure that personal data is processed lawfully, fairly, and transparently, respecting the rights, freedoms, and guarantees of the data subjects.
  • 1.3. By using the Moto.pt platform, the user accepts the terms of this Privacy Policy. If you do not agree, you must immediately cease using the services.

2. PERSONAL DATA COLLECTED

  • 2.1. Moto.pt may collect the following types of personal data:
    • When creating a registered user account, the following are collected:
      • Identification Data: Name, surname, date of birth;
      • Contact Data: Email, telephone number, address;
      • Account Data: Username, password, advert history, usage preferences;
    • NOTE: The collection of this data is done directly through forms and filled in by the user. Before collecting this data, automatic data (cookies) described below is always collected.
    • When simply visiting the site, even without creating a registered user account, the following data is transmitted:
      • Technical Data: IP address, geographical location, device type, browser, operating system;
      • Browsing Data: Cookies, browsing history, interactions with adverts, and search preferences.
    • NOTE: This data is collected automatically, through technologies such as cookies (see Cookie Policy for more information).

3. PURPOSES OF PROCESSING AND PRINCIPLES

  • 3.1. The personal data collected will be used for the following purposes:
    • Provision of Services: Allowing account creation, advert publication, transaction management, and communication between users;
    • Marketing and Advertising: Sending promotional communications, personalising adverts and marketing campaigns (WITH THE USER’S PRIOR CONSENT);
    • Platform Improvement: Data analysis to optimise the browsing experience and functionalities of Moto.pt;
    • Legal Compliance: Ensuring compliance with legal and regulatory obligations, including fraud prevention and other unlawful activities.
  • 3.2. The processing of personal data will be carried out based on the following principles:
    • Lawfulness, Fairness, and Transparency: Data will be processed transparently and fairly, on legal grounds;
    • Data Minimisation: Only data strictly necessary for the stated purposes will be collected;
    • Integrity and Confidentiality: We guarantee appropriate technical and organisational measures to protect data against unauthorised access or loss.

4. DATA SHARING

  • 4.1. Moto.pt undertakes not to sell, rent or share users’ personal data with third parties for commercial purposes, except as described in this Privacy Policy.
  • 4.2. Personal data may be shared with:
    • Service Providers: Companies contracted to process payments, send communications, or provide technical support;
    • Competent Authorities: Public or judicial bodies, in compliance with legal obligations or court orders;
    • Business Partners: Only with the user’s prior consent, data may be shared for joint campaigns or complementary services.
